Settlement Agreements: How We Help
Drafting and review
Get it right onceA settlement is only as good as its words. We draft agreements that end the dispute completely, and we review agreements you have been sent so you know exactly what you are giving up and what you are actually getting, before you sign.
Negotiating the settlement
Most disputes end hereMost disputes never go to court. We negotiate the deal itself, at mediation or in correspondence, and we structure it so it works commercially: staged payments, confidentiality, agreed consequences of default and the costs dealt with.
Enforcing the settlement
When it countsCourt is a last resort, but if the other side won't budge, then we start proceedings on the agreement itself, or enforce the Tomlin order or judgment that recorded it. A breached settlement is usually the strongest claim you will ever hold, and we make it count.

Outline your dispute and we will respond with a clear fixed fee quote the same day. Our prices are around 30% cheaper than a standard law firm because you work directly with a barrister. No hourly billing surprises.
Every quote is fixed before work begins. If the scope changes, we agree a new price with you first.
Submit Your CaseWhat Is a Settlement Agreement?
A settlement agreement is a contract that ends a dispute on agreed terms: who pays what, by when, what happens to any proceedings, and what claims are released. Almost every business dispute ends in one, because the overwhelming majority of disputes settle rather than reach trial, and the agreement is the document that converts months of argument into a binding outcome.
The drafting carries all the weight. A well drawn settlement ends the dispute completely and is straightforward to enforce if the other side defaults; a poorly drawn one releases claims you meant to keep, leaves payment obligations vague, or ends the litigation without securing the money. We draft, review, negotiate and enforce settlement agreements for businesses, whichever stage the dispute has reached.
What a Business Settlement Agreement Covers
These are the terms that decide whether a settlement actually works.
The payment terms
The amount, the dates, and what happens on default, including whether the full original claim revives if an instalment is missed.
The release
Which claims are settled and which survive, drawn precisely, because a release wider than intended is the most expensive drafting error in settlement.
The proceedings
How any live court claim ends: dismissal, a consent order, or a stay under a Tomlin order with the terms in a confidential schedule.
Confidentiality
Whether the settlement and its terms are secret, and what each side may say about the dispute.
Costs
Who bears the legal costs of the dispute and of the settlement itself, dealt with expressly rather than left to argument.
Mediation deals
Turning the heads of agreement signed late in a mediation into a complete, binding contract before the momentum is lost.
Default machinery
Interest, acceleration and agreed enforcement routes, so a breach is answered by machinery rather than a fresh dispute.
Settlement Agreement Law
A settlement agreement is a contract, formed and construed on ordinary contract principles, and it supersedes the dispute it settles: once concluded, the released claims are gone and the parties' rights are those in the agreement. Where court proceedings are on foot, a settlement is commonly recorded in a Tomlin order, which stays the proceedings on the agreed terms and allows either party to return to court to enforce them without issuing a fresh claim, with the terms themselves kept in a confidential schedule. A settlement reached at mediation becomes binding when reduced to writing and signed, and until then the without prejudice rule protects the negotiations from disclosure. Breach of a settlement agreement is a breach of contract, remedied by damages or, where the order provides, by direct enforcement, and the standard six year limitation period under the Limitation Act 1980 applies.
How Do We Settle a Dispute Properly?
We always start with a conference so that we understand the situation in full. We pair that with legal research bespoke to every case that we deal with, which means we can give you clear advice on your legal position. From there, we add in what you want out of a dispute and how far that can be achieved through legal remedies. Once we know that, we present the situation to the other side in a letter before claim that brings home the seriousness of the situation, and is usually key in bringing the other side to the table. We strongly favour mediation as a powerful tool in all of the disputes we handle for our clients, and we have a high success rate for settling cases at mediation. If your case doesn't settle, then all of the work done already means that we're in a position to start legal proceedings and allow the court to decide.
