Property Dispute Resolution: Your Options

01

Negotiation

Lowest cost

Most disputes never go to court. We set out your position in a letter that makes the other side take it seriously, and we negotiate from strength, whether you are the landlord or the tenant.

02

Property dispute mediation

Most disputes end here

A neutral mediator helps both sides reach a deal in a day. Private, quick and far cheaper than trial, and it preserves the landlord and tenant relationship that usually has years left to run.

03

Property litigation

When it counts

Court is a last resort, but if the other side won't budge, then we start proceedings. We litigate to win, and we tell you honestly when litigation is not worth it.

Get Legal Clarity

Outline your dispute and we will respond with a clear fixed fee quote the same day. Our prices are around 30% cheaper than a standard law firm because you work directly with a barrister. No hourly billing surprises.

Every quote is fixed before work begins. If the scope changes, we agree a new price with you first.

What Is a Commercial Property Dispute?

A commercial property dispute is a serious disagreement about business premises, most commonly between a commercial landlord and tenant over the lease that binds them. The dispute might be about rent, repairs, service charges, renewal, or whether the lease survives at all. Because the premises are usually essential to the tenant's trade and the rent essential to the landlord's income, these disputes carry commercial pressure on both sides from day one.

The good news is that most commercial property disputes settle without a courtroom, because both parties usually need the relationship, or at least an orderly end to it, more than they need a judgment. The earlier you understand your legal position under the lease, the stronger that position is. We act for landlords and tenants, we tell you where you stand in plain English, and we set out your options with the cost of each.

How Commercial Property Disputes Arise

Most disputes we see come from the same places, on both sides of the lease.

Commercial lease disputes

The parties disagree about what the lease requires, from repair obligations to permitted use, alterations and assignment.

Lease renewal

The lease is ending and the landlord opposes renewal, or the parties cannot agree the terms of the new lease.

Commercial rent disputes

Rent arrears build up, or the landlord pursues recovery while the tenant disputes what is owed.

Service charge disputes

The service charge demanded does not match the services delivered, or costs are loaded onto tenants beyond what the lease allows.

End of lease repairs

The landlord serves a schedule of dilapidations and the repair bill is far larger than the tenant expected.

Forfeiture

The landlord moves to end the lease and take back the premises, and the tenant needs relief to save its business.

Rent review

The review mechanism produces a figure one side considers indefensible, and the lease’s process has to be worked properly.

Commercial Property Law

Commercial landlord and tenant disputes are decided first by the lease itself and then by a framework of statute. Part II of the Landlord and Tenant Act 1954 gives most business tenants security of tenure: the right to remain at the end of the lease and to seek a new one, which the landlord can only oppose on the statutory grounds, with strict notice procedures on both sides. Forfeiture is governed by the lease's forfeiture clause and section 146 of the Law of Property Act 1925, with the court able to grant a tenant relief. A tenant's liability for end of lease repairs is capped by section 18 of the Landlord and Tenant Act 1927 at the damage to the landlord's reversion. Rent recovery, rent review and service charges are creatures of the lease, construed on ordinary contract principles, which is why the wording of the lease decides most disputes before any statute is reached.

How do I solve a commercial property dispute?

We always start with a conference so that we understand the situation in full. We pair that with legal research bespoke to every case that we deal with, which means we can give you clear advice on your legal position. From there, we add in what you want out of a dispute and how far that can be achieved through legal remedies. Once we know that, we present the situation to the other side in a letter before claim that brings home the seriousness of the situation, and is usually key in bringing the other side to the table. We strongly favour mediation as a powerful tool in all of the disputes we handle for our clients, and we have a high success rate for settling cases at mediation. If your case doesn't settle, then all of the work done already means that we're in a position to start legal proceedings and allow the court to decide.
