Litigation Problems We Help With
Tell us what is happening and we will point you to the right place. Most clients arrive with one of these:
The Stages of Commercial Litigation
Every court claim moves through the same stages, and each one is an exit. Most cases never reach the later stages, because each step changes both sides’ arithmetic.
01. Letter before claim
A well drafted letter, paired with an early settlement offer, resolves a large share of disputes before anything is issued. The dispute is set out and answered under the pre action protocol.Weeks
02. Issue and defence
The claim form and particulars are issued and the defence follows. The battle lines are fixed here, which is why the pleadings get the barrister’s hand from the start.Month one
03. Case management
The court sets the timetable and the costs framework. Weak claims and defences can be attacked now by summary judgment or strike out, ending the case before the expensive stages.Early months
04. Disclosure and evidence
Documents are disclosed and witness and expert evidence exchanged. Both sides finally see the whole board, and this is where most remaining cases settle, usually prompted by a well timed Part 36 offer.Months
05. Trial
The judge hears the evidence and argument and decides. Costs generally follow the result. Few disputes get this far, and the side genuinely prepared to win at trial is the side that settled well before it.A year or more
06. Enforcement
A judgment becomes money through writs of control, charging orders and third party debt orders, chosen against what the debtor actually has. We plan enforcement before issue, not after victory. After judgment
How Cases Conclude
Settlement
The most common ending at every stage, recorded in a settlement agreement or Tomlin order so it is enforceable if the other side defaults.
Early knockout
Summary judgment or strike out ends a claim or defence with no real prospect of success, without a trial.
Judgment
The court decides, awards remedies from damages to injunctions, and usually orders the loser to contribute to the winner’s costs.
Walking away
Sometimes the right answer: where the merits, the costs or the other side’s ability to pay do not justify continuing, we say so early, before the money is spent.
Commercial Litigation Lawyers in Birmingham City Centre
Based at 55 Colmore Row in central Birmingham, Pinpoint Lawyers is a barrister led litigation practice that acts for companies, directors and business owners across the West Midlands and throughout England and Wales. Our commercial litigation lawyers bring and defend claims across the full range of business disputes, from contract and payment claims to shareholder, director and property litigation, and every case is assessed as an investment decision, with the costs, the risks and the other side's ability to pay weighed before serious money is committed.
Barrister led means the advocate who would argue your case in court advises you from the first conference, so the strategy is built around how the case will actually play before a judge, not handed over at the courtroom door. Every stage is a fixed fee agreed in advance, around 30% cheaper than a standard law firm, and whether you need to sue, are being sued, or need an urgent injunction, you will have a response the same day.

From First Letter to Final Judgment

Position and Pressure
Most disputes never go to court. We build the case as if it will be tried, then apply the pressure that settles it: a letter before claim with the evidence in view, and Part 36 offers that put the costs risk on the other side.
Interim Steps
Where waiting for trial would cause real damage, we move first: injunctions to stop the harm, security for costs against hollow claimants, and summary judgment to end weak claims and defences early.
Trial and Enforcement
Court is a last resort, but if the other side won't budge, we take the case to trial with the barrister who has run it from day one, and we enforce the judgment until it is money in your account.
