Contractual Disputes We Resolve

Tell us what is happening and we will point you to the right place. Most clients arrive with one of these:

Contract Dispute Resolution: Your Options

01

Negotiation

Lowest cost

Most disputes never go to court. We set out your position in a letter before claim that makes the other side take the breach seriously, and we negotiate from strength.

02

Mediation

Most disputes end here

A neutral mediator helps both sides reach a deal in a day. Private, quick and far cheaper than trial, and courts expect it to be attempted before proceedings.

03

Litigation

When it counts

Court is a last resort, but if the other side won't budge, then we start proceedings. We litigate to win, and we tell you honestly when a claim is not worth it.

Get Legal Clarity Today

Outline your dispute and we will respond with a clear fixed fee quote the same day. Our prices are around 30% cheaper than a standard law firm because you work directly with a barrister. No hourly billing surprises.

Every quote is fixed before work begins. If the scope changes, we agree a new price with you first.

What Is a Contract Dispute?

A contract dispute arises when the parties to a legally binding agreement disagree about what it requires or whether it has been performed. The most common form is breach of contract: one party fails to perform an obligation owed under the agreement without lawful justification, whether by not paying, delivering late, delivering something defective or walking away from the deal entirely.

Most contractual disputes settle without a courtroom. The strength of your position depends on the terms, the evidence of what was agreed and what was done, and how early you act. We tell you where you stand in plain English, what your options are and what each one costs.

How Contract Disputes Arise

Most contractual disputes we see come from the same places.

Non payment

Invoices go unpaid, or payment is withheld against alleged defects or set off. Where the debt is undisputed, debt recovery is often the faster route.

Non delivery

Goods or services are not delivered at all, or arrive too late to be of use.

Defective performance

The work was done, but not to the standard the contract required.

Repudiation

One party makes clear it no longer intends to be bound and the other must decide how to respond.

Building contracts

Construction and building contract disputes involving defective works, delays, variations, payment disputes and adjudication. See our dedicated building contract disputes page for construction specific guidance.

Terms disputed

The parties disagree about what the contract means, which terms were incorporated, or whether a binding agreement was formed at all.

Accused of breach

You are defending an allegation that you broke the contract and need to know how strong the claim against you is.

Contract Dispute Law

Contract disputes in England and Wales are governed by the common law of contract, supplemented by statute where applicable. The basic principle is that agreements freely entered into should be enforced according to their terms. Remedies for breach include damages, specific performance and injunctive relief. The Limitation Act 1980 sets the time limits for bringing claims: six years for simple contracts and twelve years for contracts executed as deeds. Where the contract involves the sale of goods or the supply of services, the Sale of Goods Act 1979 and the Supply of Goods and Services Act 1982 imply terms as to quality, fitness for purpose and performance within a reasonable time. Disputes involving partnership agreements, shareholder agreements or director service agreements carry additional considerations specific to those relationships.

How Do I Solve a Contract Dispute?

We always start with a conference so that we understand the situation in full. We pair that with legal research bespoke to every case that we deal with, which means we can give you clear advice on your legal position. From there, we add in what you want out of a dispute and how far that can be achieved through legal remedies. Once we know that, we present the situation to the other side in a letter before claim that brings home the seriousness of the situation, and is usually key in bringing the other side to the table. We strongly favour mediation as a powerful tool in all of the disputes we handle for our clients, and we have a high success rate for settling cases at mediation. If your case doesn't settle, then all of the work done already means that we're in a position to start legal proceedings and allow the court to decide.
