Commercial Lease Advice: How We Help
Lease review
Before you signWe review the lease and report in plain English on what you are agreeing to: the rent and review pattern, the repair obligations, service charges, the term, breaks and what happens at the end. You sign knowing exactly what you are taking on.
Drafting and negotiation
Your terms, protectedWe draft leases for landlords and negotiate terms for tenants, from heads of terms onward. The lease you sign decides every dispute you might ever have, so this is the cheapest legal work you will ever buy.
Renewal, assignment and exit
Through the termWe handle lease renewals, assignments, subletting and licences, break notices and early exits, and where a landlord's consent is needed we make the application that gets a yes.
Get Legal Clarity
Outline your dispute and we will respond with a clear fixed fee quote the same day. Our prices are around 30% cheaper than a standard law firm because you work directly with a barrister. No hourly billing surprises.
Every quote is fixed before work begins. If the scope changes, we agree a new price with you first.
Submit Your CaseWhat Does a Commercial Lease Solicitor Do?
A commercial lease solicitor advises on the legal agreement that governs business premises: drafting it for landlords, reviewing and negotiating it for tenants, and handling the events that arise during the term, from rent reviews and consents to renewal and exit. A commercial lease commonly runs for years and commits the tenant to far more than rent, including repair obligations that can outlast the paint and service charges that move with the landlord's spending.
Most commercial lease problems are created on the day the lease is signed, not the day the dispute starts. Clear commercial lease advice before signature costs a fraction of the dispute it prevents. We act for landlords and business tenants, we report in plain English.
What We Check in a Commercial Lease
These are the clauses that decide whether a lease is safe to sign.
The term and security
How long the lease runs and whether the tenant has security of tenure and a right to renew at the end.
Rent and review
What the rent is, how and when it is reviewed, and in whose favour the review clause is drafted.
Repairs
Whether the repairing obligation is full or limited by a schedule of condition, because full repairing leases of old buildings produce painful end of lease bills.
Service charges
What the landlord can recover, whether there is a cap, and how costs are certified and apportioned. See also our service charge dispute solicitors.
Breaks
Whether either party can end the lease early, and the conditions on which a break notice succeeds or fails.
Assignment and subletting
Whether the tenant can pass the lease on, and what consent the landlord can require.
Heads of terms
The commercial deal recorded before drafting starts, where the strongest negotiating position is won or lost.
Commercial Lease Law
A commercial lease is a contract, construed on ordinary contract principles, sitting within a statutory framework. Part II of the Landlord and Tenant Act 1954 gives most business tenants security of tenure and a right to renew, unless the lease is contracted out of the Act by the statutory procedure before signature, which is one of the most consequential decisions in any lease negotiation. Assignment and subletting are governed by the alienation provisions and by statute requiring a landlord not to withhold consent unreasonably where the lease says consent is required. A tenant's repairing liability at the end of the term is capped by section 18 of the Landlord and Tenant Act 1927, and break clauses are enforced strictly according to their conditions, which is why break notices fail more often than any other step in a lease.
How do we advise on a commercial lease?
We always start with a conference so that we understand the transaction in full: the premises, the commercial deal and what the lease needs to do for your business. We pair that with a clause by clause review or draft, backed by legal research bespoke to every matter, which means we can report to you in plain English on exactly what you are agreeing to. From there, we negotiate the terms that matter, from repair obligations to breaks and renewal rights, before anything is signed. Everything is done at a fixed fee agreed in advance, and if a dispute ever does arise, the lease we helped you agree is the strongest position you can start from.
