Land Dispute Resolution: Your Options
Negotiation
Lowest costMost disputes never go to court. We establish the position from the title, the plans and the documents, and we put it to the other side in terms that make the dispute worth ending, whether by agreement, a deed or a payment.
Mediation and expert routes
Most disputes end hereA neutral mediator, or a jointly instructed surveyor on boundary questions, resolves the dispute privately. Quick, far cheaper than trial, and the usual route where the parties will remain neighbours.
Litigation
When it countsCourt is a last resort, but if the other side won't budge, then we start proceedings, from injunctions protecting your land to claims resolving title. We litigate to win, and we tell you honestly when the land is not worth the fight.

Submit Your CaseWhat Is a Land Dispute?
A land dispute is a disagreement about who owns land, where it ends, or what can be done on or over it. For a business the land is rarely abstract: it is the yard the lorries turn in, the access the customers use, the site the development depends on. The most common commercial land disputes concern boundaries, rights of way and other easements, restrictive covenants, unauthorised occupation, and contracts for the sale, option or development of land.
Land disputes are decided on documents more than memories: the registered title, the plans, the conveyancing history and what has actually happened on the ground over the years. That is good news, because it means your position can usually be established with confidence before any fight begins. We act for landowners, occupiers and developers, and we tell you where you stand in plain English.
How Land Disputes Arise
Most land disputes we see come from the same places.
Property boundary disputes
The title plans, the fences and the parties’ assumptions disagree about where one site ends and the next begins.
Rights of way
An access used for years is blocked, or a neighbour asserts a right over your land that the title does not obviously support.
Restrictive covenants
An old covenant on the title restricts use or development, and its enforceability and reach are contested.
Unauthorised occupation
Someone occupies or encroaches on your land without consent, or a long occupation ripens into a claim to the land itself.
Land contracts
A sale, option, overage or development agreement is not performed as agreed, and the value of the site turns on the outcome.
Access obstruction
Deliveries, parking or customer access to business premises are obstructed and the trade suffers day by day.
Neighbouring works
Construction next door interferes with your land, your access or your rights of light and support.
Land Dispute Law
Land disputes in England and Wales are decided within the framework of registered land. The registered title is the starting point for ownership, though the filed plan shows general boundaries rather than the exact line, which is why boundary disputes turn on the conveyancing history and the features on the ground. Easements such as rights of way arise by express grant, by implication or by long use, and restrictive covenants bind successors where properly protected on the title, with a statutory jurisdiction to discharge or modify obsolete covenants. Claims to land by long occupation are governed by the adverse possession regime of the Land Registration Act 2002, which for registered land requires the occupier to apply and gives the registered owner the opportunity to object. Contracts for the sale or other disposition of land must be in writing and signed to be enforceable.
How Do I Solve a Land Dispute?
We always start with a conference so that we understand the situation in full. We pair that with legal research bespoke to every case that we deal with, which means we can give you clear advice on your legal position. From there, we add in what you want out of a dispute and how far that can be achieved through legal remedies. Once we know that, we present the situation to the other side in a letter before claim that brings home the seriousness of the situation, and is usually key in bringing the other side to the table. We strongly favour mediation as a powerful tool in all of the disputes we handle for our clients, and we have a high success rate for settling cases at mediation. If your case doesn't settle, then all of the work done already means that we're in a position to start legal proceedings and allow the court to decide.
