Retention Not Released? What Subcontractors Can Do

Retention is the part of each payment that is held back, commonly 3% to 5%, with half usually due at practical completion and the rest at the end of the defects period, on the dates your contract sets. If it has not been paid when due, we check the release terms in your contract, send a formal demand, and if that fails refer the dispute to adjudication, which gives a binding decision usually within 28 days. Act quickly: retention held by a contractor that becomes insolvent usually ranks as an unsecured debt unless the contract required it to be held in trust.

Where Birmingham Construction Disputes Are Decided

Most construction disputes are decided by adjudication. The Housing Grants, Construction and Regeneration Act 1996 gives every party to a qualifying construction contract the right to refer a dispute to an independent adjudicator at any time, and the decision binds both sides until the dispute is finally resolved. When a decision is not paid, or a dispute needs a final answer, it goes to the Technology and Construction Court, which sits in Birmingham at the Birmingham Civil and Family Justice Centre, Priory Courts, 33 Bull Street, a short walk from our office, or to arbitration where the contract requires it.
