Commercial Debt Recovery: Your Options
Demand and negotiation
Lowest costMost disputes never go to court. A letter of claim from a law firm moves an invoice from the bottom of the debtor’s pile to the top, and adds statutory interest, compensation and costs to the number they are ignoring. Most debts are paid or settled at this stage.
Statutory demand
Focuses the mindWhere a company owes an undisputed debt, a statutory demand starts the clock towards winding up. Few finance directors let that clock run. Used correctly it is the fastest pressure available; used on a disputed debt it backfires, which is why we assess the dispute risk first.
Debt litigation and enforcement
When it countsCourt is a last resort, but if the other side won't budge, then we start proceedings, obtain judgment and enforce it, from High Court enforcement officers to charging orders over property. We litigate to win, and we tell you honestly when a debtor is not worth pursuing.

Outline your dispute and we will respond with a clear fixed fee quote the same day. Our prices are around 30% cheaper than a standard law firm because you work directly with a barrister. No hourly billing surprises.
Every quote is fixed before work begins. If the scope changes, we agree a new price with you first.
Submit Your CaseWhat Is Commercial Debt Recovery?
Commercial debt recovery is the process of turning money owed to your business into money in your account: unpaid invoices, sums due under contracts and loans, and judgments that have not been satisfied. The law is firmly on the creditor's side, with statutory interest and compensation on late commercial payments, court procedures built for undisputed debts, and insolvency pressure available against companies that can pay but will not.
The judgment that matters most comes before any court is involved: whether the debtor can pay, and which route gets there fastest. A strong claim against an empty company is worth less than a modest claim against a solvent one, so we assess the debtor before we advise on the strategy. We act for creditors of every size, and where a debt is disputed we act on the defending side too.
How Debt Problems Arise
Most recovery instructions we see start in one of these places.
Aged invoices
The debtor book grows, chasing emails achieve nothing and the oldest invoices quietly pass ninety days.
Silence
A previously good customer stops answering, which is usually a sign of cash trouble and a reason to move quickly.
Disputed invoices
The debtor raises complaints about the goods or services, sometimes genuine, often tactical, and the debt becomes a contract dispute.
Can’t pay, won’t pay
The debtor pleads poverty while continuing to trade, and the question becomes what pressure and what evidence changes their answer.
Unpaid judgments
A judgment or agreed settlement is simply ignored, and enforcement is needed to collect it.
Contract and loan debts
Money due under agreements, guarantees and loans rather than invoices, where the paperwork decides the claim.
Defending
Your business is on the receiving end of a demand or claim for a debt it disputes, and the response needs to be right first time.
Debt Recovery Law
Commercial debt claims are contract claims, pursued under the Civil Procedure Rules, and where the debtor is an individual or sole trader the Pre Action Protocol for Debt Claims applies, requiring prescribed information and time before proceedings. The Late Payment of Commercial Debts (Interest) Act 1998 adds statutory interest at 8% above the Bank of England base rate to qualifying business to business debts, together with fixed compensation per invoice and the reasonable costs of recovery. Insolvency pressure is available against corporate debtors: a statutory demand for an undisputed debt of £750 or more founds a winding up petition if unpaid for 21 days, though the courts restrain petitions built on genuinely disputed debts. Judgments are enforced through writs of control executed by High Court enforcement officers, charging orders over land, third party debt orders over bank accounts and, against individuals, attachment of earnings.
How Do I Recover a Business Debt?
We always start with a conference so that we understand the situation in full. We pair that with legal research bespoke to every case that we deal with, which means we can give you clear advice on your legal position. From there, we add in what you want out of a dispute and how far that can be achieved through legal remedies. Once we know that, we present the situation to the other side in a letter before claim that brings home the seriousness of the situation, and is usually key in bringing the other side to the table. We strongly favour mediation as a powerful tool in all of the disputes we handle for our clients, and we have a high success rate for settling cases at mediation. If your case doesn't settle, then all of the work done already means that we're in a position to start legal proceedings and allow the court to decide.
