Construction Dispute Resolution: Your Options
Negotiation
Lowest costMost disputes never go to court. We set out your position, backed by the contract, the payment record and the site evidence, in a letter that makes settling the cheaper option, and most building disputes resolve from there.
Adjudication
A decision in 28 daysConstruction contracts carry a statutory right to adjudication: a binding decision from an independent adjudicator, usually within 28 days, that must be paid now even if argued about later. It is the construction industry’s own fast track, and it is where most payment disputes are decided.
Litigation or arbitration
When it countsCourt is a last resort, but if the other side won't budge, then we start proceedings, in the Technology and Construction Court or in arbitration where the contract requires it. We litigate to win, and we tell you honestly when a claim is not worth the fight.

Submit Your CaseWhat Is a Building Contract Dispute?
A building contract dispute is a disagreement arising from construction work: between employer and contractor, contractor and subcontractor, or either of them and the professionals who designed or administered the project. The recurring battlegrounds are money and quality: interim payments and final accounts, variations and their valuation, defective and incomplete work, delay and the costs that flow from it, and terminations that one side says were justified and the other says were repudiation.
Construction has its own legal machinery, built for the reality that projects cannot stop while lawyers argue: statutory payment rules, notice regimes with hard deadlines, and adjudication delivering a binding decision in weeks. That machinery rewards the party who knows it and punishes the party who ignores it, whichever side of the dispute they are on. We act for employers, contractors and subcontractors, and we tell you where you stand in plain English.
How Building Contract Disputes Arise
Most construction disputes we see come from the same places.
Non payment
Invoices and applications for payment go unpaid while the work, and the contractor's own supply chain costs, carry on. Where the debt is undisputed, debt recovery is often the faster route.
Smash and grab
A payment application receives no valid payment or pay less notice in time, making the notified sum due in full regardless of the account’s true merits.
Defects
The work fails, does not conform to the specification, or is left incomplete, and the cost of rectification is disputed.
Delay
The project overruns, and the argument is over who caused it, whether extensions of time are due, and who bears the prolongation costs and any liquidated damages.
Variations
Instructed and constructive changes stack up, records are thin, and the final account bears no resemblance to the contract sum.
Abandonment and termination
A party leaves site or terminates, and whether that was lawful decides who claims against whom.
Defending
A claim, adjudication notice or damages demand lands on your business and the response clock is already running.
Construction Contract Law
Building contract disputes are decided by the contract, commonly a JCT or NEC standard form as amended, within the statutory framework of the Housing Grants, Construction and Regeneration Act 1996. For qualifying construction contracts the Act implies a right to interim payments, a notice regime under which a valid payment notice or pay less notice must be served by strict deadlines if the paying party wishes to pay less than the sum applied for, and a right to refer any dispute to adjudication at any time. An adjudicator's decision, usually delivered within 28 days, is binding and enforceable until the dispute is finally resolved by litigation or arbitration, and the Technology and Construction Court enforces adjudication decisions robustly and quickly. The general law of contract sits underneath: the classification of terms, repudiation, damages, remoteness and mitigation apply to construction as to any other contract, alongside the strict time bars many building contracts impose on claims.
How Do I Solve a Building Contract Dispute?
We always start with a conference so that we understand the situation in full. We pair that with legal research bespoke to every case that we deal with, which means we can give you clear advice on your legal position. From there, we add in what you want out of a dispute and how far that can be achieved through legal remedies. Once we know that, we present the situation to the other side in a letter before claim that brings home the seriousness of the situation, and is usually key in bringing the other side to the table. We strongly favour mediation as a powerful tool in all of the disputes we handle for our clients, and we have a high success rate for settling cases at mediation. If your case doesn't settle, then all of the work done already means that we're in a position to start legal proceedings and allow the court to decide.
