Service Charge Disputes We Resolve

Tell us what is happening and we will point you to the right place. Most clients arrive with one of these:

Service Charge Dispute Resolution: Your Options

01

Challenge and negotiation

Lowest cost

Most disputes never go to court. We audit the demand against the lease, identify what is not properly recoverable, and put the challenge in terms the other side has to answer. Most service charge disputes settle once the lease has been read properly by both sides.

02

Mediation and expert routes

Most disputes end here

A neutral mediator or an independent expert resolves the dispute privately, and many leases require a dispute route before court. Quick, private and far cheaper than litigation over years of accounts.

03

Litigation

When it counts

Court is a last resort, but if the other side won't budge, then we start proceedings. We litigate to win, and we tell you honestly when the numbers do not justify the fight.

Outline your dispute and we will respond with a clear fixed fee quote the same day. Our prices are around 30% cheaper than a standard law firm because you work directly with a barrister. No hourly billing surprises.

Every quote is fixed before work begins. If the scope changes, we agree a new price with you first.

What Is a Service Charge Dispute?

A service charge dispute is a disagreement between landlord and tenant about the sums charged for services to a building or estate: maintenance, repairs, insurance administration, management fees and major works. In commercial property the service charge is a creature of the lease, so the dispute is nearly always about what the lease actually allows the landlord to recover and whether the machinery for certifying and apportioning the charge has been operated properly.

Service charges in commercial property are where small drafting differences become large sums, because the charge repeats every year and rises with the landlord's spending. Whether you are a tenant facing a demand that does not add up or a landlord facing tenants who will not pay, the answer starts in the same place: the lease, read closely. We act for both sides, we tell you where you stand in plain English.

How Service Charge Disputes Arise

Most disputes we see come from the same places.

Unexplained increases

The charge rises sharply year on year with no matching change in the services delivered.

Services not received

Tenants are charged for services the lease does not oblige the landlord to provide, or that are not being provided at all.

Major works

A roof, plant or refurbishment programme is loaded into the service charge in one or two years, and tenants dispute whether the lease permits recovery.

Certification

The certificate that crystallises the charge is late, unclear or does not reconcile with the underlying accounts and invoices.

Apportionment

The split between tenants does not follow the lease, or has quietly changed as units have been re let.

Non payment

A landlord faces tenants withholding the charge, sometimes for good reason and sometimes as leverage on an unrelated lease dispute.

Before you sign

A tenant taking a new lease wants the service charge provisions, caps and history checked before committing. See also our commercial lease solicitors.

Service Charge Law in Commercial Property

Service charges in commercial property are governed by the lease, construed on ordinary contract principles: the landlord can recover only what the lease's words permit, and the certification and apportionment machinery must be operated as the lease prescribes. Clear words are required for unusual or onerous categories of cost, and many leases contain caps, exclusions or sweeper clauses whose reach is a recurring battleground. The RICS professional statement on service charges in commercial property sets the standards expected of managing agents and is mandatory for RICS members, so departures from it are powerful evidence in a challenge, even though the lease remains the governing document. This commercial regime is distinct from residential service charges, which carry statutory reasonableness controls and tribunal jurisdiction of their own.

How Do I Solve a Service Charge Dispute?

We always start with a conference so that we understand the situation in full. We pair that with legal research bespoke to every case that we deal with, which means we can give you clear advice on your legal position. From there, we add in what you want out of a dispute and how far that can be achieved through legal remedies. Once we know that, we present the situation to the other side in a letter before claim that brings home the seriousness of the situation, and is usually key in bringing the other side to the table. We strongly favour mediation as a powerful tool in all of the disputes we handle for our clients, and we have a high success rate for settling cases at mediation. If your case doesn't settle, then all of the work done already means that we're in a position to start legal proceedings and allow the court to decide.
