Property Dispute Resolution: Your Options

01

Negotiation

Lowest cost

Most disputes never go to court. We establish your position from the title, the lease or the contract, and we put it to the other side in a letter that makes resolving the dispute the cheaper option for them.

02

Property dispute mediation

Most disputes end here

A neutral mediator helps both sides reach a deal in a day. Private, quick and far cheaper than trial, and settlements can be shaped commercially in ways a court cannot order.

03

Property litigation

When it counts

Court is a last resort, but if the other side won't budge, then we start proceedings, in the court or tribunal the dispute belongs in, from injunctions that protect the property today to trials that resolve it for good. We litigate to win, and we tell you honestly when the property is not worth the fight.

Get Legal Clarity Today

Outline your dispute and we will respond with a clear fixed fee quote the same day. Our prices are around 30% cheaper than a standard law firm because you work directly with a barrister. No hourly billing surprises.

Every quote is fixed before work begins. If the scope changes, we agree a new price with you first.

What Is a Property Dispute?

A property dispute is any serious disagreement about land or buildings: who owns them, who can occupy them, what is owed under a lease, or what can be done on or next to them. For businesses and property owners the stakes are rarely abstract, because the property is the premises the business trades from, the asset the borrowing sits on or the investment the income depends on.

Property disputes are decided on documents more than recollections: the registered title, the lease, the contract and the correspondence. That is good news, because your position can usually be established with confidence early, and the dispute steered to the cheapest route that resolves it. We act for owners, landlords, tenants and occupiers, and we tell you where you stand in plain English.

How Property Disputes Arise

Most property disputes we see fall into one of these groups.

Lease disputes

Rent, repairs, renewal and forfeiture between commercial landlords and tenants, covered in depth on our commercial lease disputes and commercial property disputes pages.

Service charges

Charges that do not match the lease or the services delivered, covered on our service charge disputes page.

Land and boundaries

Disputed boundaries, rights of way, covenants and encroachment, covered on our land disputes page.

Possession

Occupiers who will not leave: former tenants holding over, licensees whose licence has ended, or unauthorised occupiers on your land or premises.

Ownership and title

Disagreement about who owns a property or a share of it, including properties bought together, held on trust or transferred in circumstances now disputed.

Failed deals

A sale, purchase or development agreement that has not completed as agreed, with deposits, options or the property itself at stake.

Property Litigation Law

Property litigation in England and Wales is conducted under the Civil Procedure Rules, with pre action protocols requiring the dispute to be set out and answered before proceedings, and costs generally following the result. The right forum depends on the dispute: possession and most property claims are issued in the County Court or High Court, while specialist property questions, from land registration disputes to the discharge of restrictive covenants, are decided in the property tribunals. The court's remedies run from declarations that settle ownership, to injunctions that stop interference with property today, to orders for possession, sale or specific performance. Because property is unique, injunctions and specific performance are more readily available than in ordinary commercial litigation, which is one reason property disputes reward early, well evidenced action.

How do I solve a property dispute?

We always start with a conference so that we understand the situation in full. We pair that with legal research bespoke to every case that we deal with, which means we can give you clear advice on your legal position. From there, we add in what you want out of a dispute and how far that can be achieved through legal remedies. Once we know that, we present the situation to the other side in a letter before claim that brings home the seriousness of the situation, and is usually key in bringing the other side to the table. We strongly favour mediation as a powerful tool in all of the disputes we handle for our clients, and we have a high success rate for settling cases at mediation. If your case doesn't settle, then all of the work done already means that we're in a position to start legal proceedings and allow the court to decide.
