Navigating the world of legal costs is one of the biggest worries for businesses and individuals embroiled in court claims. Clients regularly come to us wanting to know: “What can I recover if I win? Will my legal spend spiral out of control?” The answer depends on a range of factors, but our approach ensures you’re never left guessing about your outlay.
Transparency with Fixed Prices
We believe in certainty and transparency for our clients, that’s why we offer fixed prices for each stage of your litigation. No matter the complexity or size of your dispute, we make sure you know exactly what you’ll pay upfront at each stage, so you can plan your next steps with confidence.
From the outset, we discuss your objectives, review your documents, and agree a fixed price for the initial assessment. If your case proceeds, we’ll set a fixed fee for each stage: from correspondence and pre-claim negotiation, to drafting your claim or defence, through to the trial.
With fixed price litigation, you don’t pay more if the case takes longer or proves more complex, that’s our risk, not yours. We value certainty as much as you do.
What can you recover if you go to court?
Not all claims are treated equally by the courts, and what you can recover differs depending on the “track” your claim falls under. Here’s a clear, straightforward breakdown:
Multi Track (Over £100,000)
Your best chance of recovering a sizable proportion of your costs. The court sets a cost budget early on, and while you can never recover more than you actually spend, the typical recovery is around two thirds. By working with us on a fixed fee, you stand a better chance of recovering a higher proportion, the judge isn’t left questioning high hourly rates or inefficiency.
Intermediate Track (£25,000 to £100,000)
The court applies a fixed recoverable costs regime. Costs are set by complexity band and stage. If your costs are less than the prescribed cap, you may, in some cases, recover more than you spend. Our fixed fee work is structured to keep you within those bounds wherever possible, giving you financial clarity and protecting your bottom line.
Fast Track (£10,000 to £25,000)
Costs here are also fixed and typically lower than the actual work required by an experienced lawyer. This means cost effectiveness is key. Our up-front advice and fee structure help you budget sensibly and make informed decisions about whether proceeding to court is in your best interests.
Small Claims (Under £10,000)
The small claims track rarely allows recovery of legal costs, only court fees, limited expert fees, and witness expenses are recoverable. Instructing a lawyer is generally only worthwhile for non-monetary cases that carry deep personal or strategic importance.
Practical, plain-English advice
Our specialist lawyers combine in-depth technical knowledge of the courts’ cost rules with real-life experience guiding clients through litigation. We review your case, give you frank advice on likely results, and work with you to devise the best strategy.
Most importantly, we always do this with a clear view of the financial realities. You’ll always know your potential spend, what the recovery options look like, and where the risks and opportunities lie.
Before we start, we’ll have an open discussion about your priorities and put together a clear proposal for each stage. If the case develops in complexity or scope, you’ll know the cost before we proceed further. We think fixed fees are better for our clients, and that works for us too.
